Applicability of the terms and conditions
These terms and conditions apply to all offers and agreements between D.W.F. Netherlands, hereinafter referred to as seller and buyer, hereinafter referred to as buyer.
The terms and conditions shall be deemed to be known to the buyer as well as to be/have been accepted by buyer, unless in special offers or invoices show that departed by mutual consent. Then apply the terms and conditions as well as divergent conditions.
 
Any offer is without obligation. Upon acceptance of an offer by buyer, the terms and conditions as well as, where appropriate, by the seller and buyer agreed different terms and conditions shall be deemed to have been accepted by buyer.
Conclusion of a contract is based on the prices, in force at the time of closing.
 
Order and communication
For misunderstandings, mutilations, delays or incomplete orders and notices as a result of the use of internet or any other means of communication between buyer and seller or between seller and third parties, as far as pertaining to the relationship between buyer and seller is seller will not be responsible in case of intent or gross negligence of the seller.
 
Delivery
All deliveries take place at the expense and risk of the buyer. Force majeure
Without prejudice to the other rights due to its hospitality management in cases of force majeure, has the right to, at its option, to suspend the implementation of Buyers order or to dissolve the agreement without judicial intervention, this in writing by the buyer and Seller without being held to any compensation, unless in the circumstances to standards of reasonableness and fairness would be unacceptable. Force majeure means any shortcoming which are not attributable to the seller, because he is not due to his fault and not under the law, legal act or generally accepted on his behalf.
 
Payment
All payments must be made with Bancontant/Mister Cash, iDeal, instant bank transfer or bank transfer and to be paid for delivery, unless otherwise agreed. If the seller warranty obligations are not, not yet or has failed, has not the right to refuse payment Buyer. Seller reserves the right to set off claims against Buyer with his debts to buyer, even if the claims against buyer does not become due and payable. Returning goods
Buyer has the right, within a period of fourteen days to return the goods. The products must be unused and in the state of new purchase, to be packed in original and undamaged packaging. For successfully returning a purchase the buyer must follow the steps that are to be found on our returnpage.
The costs incurred for the return (for the then-current rate) receives Buyer's return together with the purchase price within 14 days of receiving the goods.
 
Not registered mail will be refused.
 
Prices
All prices on the website include VAT, shipping costs within the Netherlands, charges and/or rights unless otherwise state.
 
Intellectual and industrial property rights
Buyer is responsible for all intellectual and industrial property rights attached to the products supplied by seller to respect fully and unconditionally. Seller does not warrant that the products delivered to buyer do not infringe any (unwritten) intellectual and/or industrial property right of third parties.
 
Warranty and warranty claims
Seller grants a 24 months warranty on factory defects on all of its timepieces. The warranty is not valid for case, strap, glass and batteries.
 
A warranty claim is treated only if goods complete, in original packaging, in original unused condition, with a completed return form and a return number. Prior to the return of a watch with warranty claim the buyer must follow returns.
 
Seller shall make a return in accordance with the law, on all products of the seller. If Exchange is impossible by seller will be exchanged at the option of seller against similar goods or to crediting. For an Exchange is €. 25.00 will be charged.
 
Other provisions
If the buyer to the seller in writing of an address, seller is entitled to that address to send all orders, unless buyer the seller in writing of another address to which buyers orders are to be sent. When retailer during any period of time whether or not implied deviations from these conditions, this shall not affect its strict compliance with this condition. Applicable law and competent court
All rights, obligations, offers, orders and agreements to which these conditions apply, as well as to those conditions, is exclusively Dutch law is applicable. If one or more of the provisions of these terms and conditions or any other agreement with seller in violation with any applicable legal provision, the relevant provision will lapse and will be replaced by a retailer to fix new comparable provision. Seller shall be responsible for the execution of your order (s) use of third parties.
 
In the event of a dispute, exclusive jurisdiction is the District Court in the Hague, or the district judge under whom the seller's place of business.
